Cazoo Match Day Competition - Terms and Conditions

1. The promoter

The promoter is Cazoo Limited (“Cazoo”) of 41 Chalton Street, London, NW1 1JD.

2. The competition

2.1 The title of the competition is The Cazoo Match Day Competition. This competition is to win an opportunity to take part in a filmed football challenge in order to compete for a prize.

2.2 The competition is free to enter, however you should be aware that you may be subject to local data charges depending on your own individual arrangements for internet access.

2.3 Cazoo and Everton will select at least nine participants for the challenge at random from all of the valid entries that are received before the Closing Time (defined below). Cazoo may in its sole discretion select more than nine participants for the challenge should COVID-19 continue to impact fans’ ability to attend live matches beyond the current expectations of Cazoo.    

3. How to enter

3.1 The competition will run from 09:00 on 19th September 2020 (UK time) (the “Opening Time”) to 09:00 on 30th June 2021 (UK time) (the “Closing Time”) inclusive.

3.2 All entries must be received by Cazoo by no later than the Closing Time. All entries received after the Closing Time are automatically disqualified. The time of the entry will be the time of receipt of the entry as recorded by Cazoo.

3.3 To enter the competition, you must:

- 3.3.1 be available to participate in the challenge at 10:00 on 13th November 2020 at a location close to Goodison Park to be confirmed (participation in the challenge will take approximately 1 hour)

- 3.3.2 consent to being filmed by signing Cazoo’s video and image release form on the day of the challenge;

- 3.3.3 be a supporter of Everton Football Club; and 

- 3.3.4 complete the form on the Cazoo website, details of which are available via Cazoo’s official Facebook, Twitter and Instagram pages.

3.4 Cazoo may, in its sole discretion, change the time, date and location stated in paragraph 3.3(a) if it becomes necessary to do so. Cazoo will notify selected participants of any such changes. 

3.5 No purchase is necessary.

3.6 Cazoo does not accept responsibility for entries that are lost, mislaid, damaged or delayed, regardless of cause, including (for example) as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.7 Cazoo will contact those selected to take part as soon as reasonably practicable after the Closing Time using the contact details provided with their entries. Unsuccessful entries will not receive any notification.

3.8 By entering the competition, you agree to be bound by these terms and conditions and you confirm that you (or the other person taking part on your behalf, if relevant) are physically able to take part and there is no other reason why you (or the other person taking part on your behalf) should not take part.

4. Eligibility

4.1 The competition is only open to UK residents aged 18 years or over, except:

- 4.1.1 employees, contractors and workers of Cazoo or its group companies;

- 4.1.2 anybody who is professionally connected with the competition or its administration; or

- 4.1.3 members of the immediate families or households of anyone in (a) and (b) above.

4.2 By entering the competition, you confirm that you're eligible to do so and to claim any prize that you win. Cazoo may require you to prove that you're eligible to enter the competition.

4.3 Cazoo will not accept entries that are:

- 4.3.1 automatically generated by computer;

- 4.3.2 completed by third parties or in bulk;

- 4.3.3 illegible, have been altered, reconstructed, forged or tampered with; or

- 4.3.4 incomplete.

4.4 There is a limit of one entry to the competition per person. Entries on behalf of another person and joint entries are not allowed. If you're selected to take part and Cazoo believes that you have entered more than once, Cazoo may select an alternative participant instead. Any alternative participants will be selected using the same criteria as the original participant.

4.5 Cazoo may disqualify you if your conduct is contrary to the spirit or intention of the competition.

4.6 If:

- 4.6.1 Cazoo is unable to make contact with you within a reasonable time after the Closing Time (as determined by Cazoo’s sole discretion); or

- 4.6.2 you're unable to attend on the day of the challenge; or 

- 4.6.3 you tell Cazoo that you do not wish to take part in the competition,

then you will forfeit the opportunity to take part and Cazoo may select an alternative participant. Any further participants will be selected using the same criteria as the original participant.

5. The day of the challenge

5.1 This section applies only if you have been selected to take part.

5.2 You must take part personally, unless you're registered as disabled or are in receipt of the medium or higher rate component of disability living allowance. If this is the case, you may choose a friend or family member to take part on your behalf. If you need someone else to take part on your behalf, you must tell Cazoo as soon as you can before the day of the challenge. If someone else takes part on your behalf, any prize won belongs to you (and not the person taking part on your behalf).

5.3 The challenge is a physical activity, so you (or the other person taking part on your behalf) should wear appropriate clothing and non-slip footwear to be allowed to take part. You (or the other person taking part on your behalf) should take extra care when taking a kick if the playing surface is wet.

5.4 When you arrive at the location of the challenge, Cazoo will ask to see a copy of the confirmation message from Cazoo (showing a copy on your mobile device is fine) and proof of identity in the form of a passport or photocard driver's licence. If you can’t show this information when requested or if you're not (in Cazoo’s opinion) appropriately dressed or physically able to take part, you will forfeit the opportunity to take part. Cazoo may select another participant using the same criteria. Cazoo will not reimburse you for any expenses you incur in relation to your participation in the challenge.  

5.5 You must take your kick from the spot indicated by Cazoo. The spot will be approximately 12 yards from the target. If you (or the person taking part on your behalf) kick the ball and it travels through a marked segment on the target, you will (subject to clause 6 below) win the prize indicated on that segment. You will only win a prize for a successful kick that does not ricochet off any other objects or people except the target itself. 

5.6 You (or the person taking part on your behalf) may only take one kick.

5.7 If the ball travels through more than one segment of the target, you will only win the prize relating to the segment through which the ball travelled first. Cazoo’s decision is final.

5.8 Cazoo may disqualify you at any time if your conduct is contrary to the spirit or intention of the competition.

6. The prizes

6.1 The prizes available are:

- 6.1.1 £1,000 cash (to be settled via bank transfer or another payment method specified by Cazoo); or

- 6.1.2 a car priced at £10,000 or less which is available on Cazoo’s website (www.cazoo.co.uk) at the time the prize is redeemed.

6.2 If a winner selects a car priced at more than £10,000, the winner must pay to Cazoo the difference between £10,000 and the price of the car selected. Such amount can either be settled by payment to Cazoo and/or part exchange of a current car owned by the winner. If the value of the current car owned by the  winner to be part exchanged exceeds the difference between £10,000 and the price of the car selected, the winner will not be entitled to receive the surplus part exchange amount in cash. If the value of the current car owned by the winner to be part exchanged is less than the difference between £10,000 and the price of the car selected, the winner must pay to Cazoo the difference between (i) £10,000 and the value of the current car owned by the winner to be part exchanged and (ii) the price of the car selected.  

6.3 If a winner selects a car priced at less than £10,000, then the winner is not entitled to any cash alternative for the difference between the price of the car and £10,000.  Only one prize can be won by each winner. 

6.4 Cazoo reserves the right to replace the prize with an alternative prize of equal or higher value if the original prize is not available.

6.5 The prize is not transferable, exchangeable or negotiable. There is no cash alternative to the prize.

7. Selection of participants

7.1 Cazoo’s decision is final and no correspondence or discussion will be entered into.

7.2 Cazoo must make available information that indicates that a valid prize award took place. To comply with this obligation, Cazoo will send the surname and county of people selected to take part and prize winners to anyone who emails [email protected] within one month after the Closing Time or the challenge (as applicable). If you object to your surname, county or winning entry being made available, please contact Cazoo at [email protected]. If you do this, Cazoo must still provide the information to the Advertising Standards Authority on request.

8. Claiming the prize

8.1 If you win a prize, you will have seven days after the challenge to provide all information requested by Cazoo to administer the prize. If you do not do this by this date, your claim will become invalid.

8.2 The prize may not be claimed by someone else on your behalf.

8.3 If your prize is a car, you must select a car within 12 months after the date of the challenge. If you do not do this by this date, you will forfeit your prize.

8.4 Cazoo does not accept any responsibility if you're not able to take up the prize.

9. Limitation of liability

As far as permitted by law, Cazoo, its agents and distributors are not in any circumstances liable to compensate the any participants or accept any liability for any loss, damage, personal injury or death occurring as a result of participating in the competition or taking up the prize, except where this is caused by the negligence of Cazoo, its agents or distributors or that of its employees. Your statutory rights are not affected.

10. Ownership of entries and intellectual property rights

10.1 Cazoo does not claim any rights of ownership in your competition entry.

10.2 You agree that Cazoo may, but is not required to, make your entry available on its websites and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You grant Cazoo a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in your entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-license the entry and any accompanying materials for those purposes. You also agree to waive all moral rights in and to your entry to which you may now or at any time in the future be entitled anywhere in the world.

11. Data protection and publicity

11.1 Cazoo will only process your personal information as set out in its Privacy Policy and to announce winners as described in paragraph 7.2 above.

11.2 You agree to participate in a reasonable amount of publicity on Cazoo’s behalf if asked to do so by Cazoo. This might include publishing your name and photograph in any media.

11.3 Selected participants will be required to participate in publicity including being filmed and having such footage appear on any media. 

12. General

12.1 If Cazoo believes that you have breached these terms and conditions, Cazoo may (at its sole discretion) exclude you from participating in the competition.

12.2 Cazoo may void, suspend, cancel or amend the competition if it becomes necessary to do so.

12.3 These terms and conditions are governed by English law. All entrants to the competition submit to the exclusive jurisdiction of the courts of England and Wales, except that if you're resident in Northern Ireland you may also bring proceedings in Northern Ireland, and if you're resident in Scotland, you may also bring proceedings in Scotland.
